Introduction
These terms explain what you can expect from Bloomeor and what we expect from you.
Welcome to Bloomeor. By creating an account, accessing, or using any Bloomeor service, you ("Customer", "you", or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.
These Terms form a legally binding agreement between you and Bloomeor Technologies ("Bloomeor", "we", "us", or "our"), a company registered in India. If you are using our Services on behalf of a business or institution, you represent that you have authority to bind that organisation to these Terms.
We may update these Terms from time to time. We will notify you of material changes through our platform or by email. Continued use of our Services after changes take effect constitutes your acceptance of the updated Terms.
Our Services
Bloomeor offers a range of software products designed for retail, healthcare, education, and enterprise operations.
Bloomeor provides the following cloud-based software platforms and services:
- Bloomeor POS
- A sovereign point-of-sale and retail intelligence platform designed for Indian businesses, including inventory management, billing, and customer analytics.
- Bloomeor HMS
- A hospital and healthcare management system covering patient records, OPD management, pharmacy, and Electronic Health Records (EHR).
- Bloomeor ERP
- An enterprise resource planning platform for operations, HR, finance, and institutional management.
- Custom Software
- Bespoke web applications, APIs, and automation systems developed under a separate Statement of Work (SOW).
- Cloud Services
- Hosting, monitoring, security, and infrastructure services underpinning the above platforms.
Our Services evolve continuously. We regularly add features, improve performance, and update our platforms. We will give reasonable notice before removing features that materially affect your business operations.
Accounts & Security
You are responsible for your account, your users, and keeping your credentials secure.
To use our Services, you must create an account using accurate and complete information. You are responsible for:
- Providing accurate registration information and keeping it up to date.
- Maintaining the confidentiality of your account credentials and API keys.
- Managing access roles and permissions for all users within your organisation.
- Ensuring that only authorised personnel access your account.
- Notifying Bloomeor promptly at security@bloomeor.com if you suspect any unauthorised access.
You are responsible for all activity that occurs under your account. Bloomeor cannot be held liable for any losses resulting from unauthorised access caused by your failure to protect your credentials.
Acceptable Use
Use our Services lawfully, ethically, and only for legitimate business purposes.
You may use Bloomeor Services only for lawful purposes and in accordance with these Terms. You must not:
- Use our Services in violation of any applicable Indian or international law or regulation.
- Upload, transmit, or store malware, viruses, or any malicious code.
- Attempt to reverse-engineer, decompile, disassemble, or extract source code from our software.
- Attempt to gain unauthorised access to any system, network, or data connected to our Services.
- Use our Services to harass, abuse, or harm others, or to facilitate spam or phishing.
- Resell, sublicense, or commercially redistribute our Services without our prior written consent.
- Interfere with the security, integrity, or performance of our platform or its users.
We reserve the right to suspend or terminate accounts that violate these provisions without prior notice where we determine there is immediate risk to our platform or other customers.
Subscriptions & Payment
Subscriptions are billed in advance. Taxes apply. We're clear about what happens when payments are late.
Billing Cycles
Subscriptions are billed monthly or annually in advance, as selected at the time of purchase. Subscription fees are non-refundable except where required by applicable law or as stated in our refund policy.
Taxes
All fees are exclusive of applicable Goods and Services Tax (GST), which will be added at the prevailing statutory rate. Where applicable, you are responsible for withholding tax compliance.
Late Payments
If a payment fails or is overdue, we will notify you and allow a 7-day grace period to resolve the issue. If the payment remains outstanding, we reserve the right to suspend access to your account until the balance is cleared.
Refund Policy
Annual subscriptions cancelled within 14 days of the billing date may be eligible for a pro-rated refund. Custom software engagements follow the refund terms stated in the applicable Statement of Work.
Price changes for existing subscriptions will be communicated at least 30 days in advance of the next billing cycle.
Customer Data
Your data belongs to you. We process it only to deliver your services. We will never sell it.
Your Data Belongs To You. Bloomeor does not own, sell, rent, or monetise your data. We act solely as a processor of the data you entrust to us, under your instructions and for the purpose of delivering your contracted Services.
Specifically, with respect to your data:
- You retain full ownership of all data uploaded to or generated within our Services.
- Bloomeor processes your data only as required to provide, maintain, and improve your Services.
- We do not sell, share, or disclose your data to third parties for advertising or commercial purposes.
- You may export your data at any time using our built-in data export tools.
- Upon termination, we will provide a data export window of at least 30 days before deletion.
Where Bloomeor processes personal data on your behalf, we act as a Data Processor under India's Digital Personal Data Protection Act, 2023. You remain the Data Fiduciary for your users' information. A Data Processing Agreement (DPA) is available on request.
Privacy & Security
We take security seriously. Every layer of our platform is built to protect your data.
Our information handling practices are described in our Privacy Policy, which forms part of these Terms. By using our Services, you agree to our Privacy Policy.
Bloomeor implements and maintains industry-standard security measures, including:
- AES-256 encryption for data at rest; TLS 1.3 for data in transit.
- Role-Based Access Control (RBAC) and Multi-Factor Authentication (MFA).
- Continuous security monitoring, anomaly detection, and audit logging.
- Regular independent penetration testing and vulnerability assessments.
- Logical isolation between customer environments.
Incident Response
In the event of a confirmed security incident affecting your data, Bloomeor will notify affected customers within 72 hours of becoming aware of the breach, consistent with our obligations under applicable law. We will provide clear information about the nature of the incident, the data affected, and the steps being taken to address it.
Intellectual Property
Bloomeor owns the software. You own your data. We give you a licence to use our platform.
Bloomeor and its licensors retain all right, title, and interest in and to our Services, including all software, code, designs, trademarks, and documentation.
Subject to your compliance with these Terms and payment of applicable fees, Bloomeor grants you a limited, non-exclusive, non-transferable, revocable licence to access and use our Services solely for your legitimate internal business purposes.
You retain full ownership of all Customer Data you submit to our Services. You grant Bloomeor a limited licence to process your data solely as necessary to deliver your contracted Services.
Nothing in these Terms grants you ownership rights over our software, brand, intellectual property, or technology. You may not copy, modify, create derivative works from, or attempt to extract our source code.
Service Availability
We aim for 99.9% uptime. When maintenance is needed, we'll tell you in advance.

Bloomeor does not guarantee uninterrupted access to Services. Downtime caused by factors outside our reasonable control — including internet outages, third-party provider failures, or force majeure events — is excluded from uptime calculations.
Termination
You can cancel at any time. We explain exactly what happens to your data when you do.
Customer-Initiated Cancellation
You may cancel your subscription at any time by contacting our team or using the account management tools in your dashboard. Cancellation takes effect at the end of the current billing period.
Suspension by Bloomeor
We may suspend your account immediately if you breach these Terms, fail to pay fees, or if we determine your use poses a security risk to our platform or other customers. We will notify you promptly and provide an opportunity to remedy the issue where reasonably practicable.
Data Export & Deletion
Following termination, you will have 30 days to export your data using our export tools. After this period, your data will be securely deleted from our systems. We will provide written confirmation of deletion upon request.
Disclaimers
Our Services are professional-grade, but we can't guarantee they'll be perfect for every situation.
Bloomeor provides its Services on an "as is" and "as available" basis. While we work hard to ensure quality and reliability, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.
We do not warrant that our Services will be error-free, uninterrupted, or entirely secure. No information or advice obtained from Bloomeor constitutes a warranty beyond what is expressly stated in these Terms.
Some jurisdictions do not allow the exclusion of certain implied warranties. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
Limitation of Liability
Our liability to you is limited to what you've paid us. We don't accept liability for indirect losses.
To the maximum extent permitted by applicable law, Bloomeor's total cumulative liability arising from or relating to these Terms or your use of our Services shall not exceed the total fees paid by you to Bloomeor in the twelve (12) months immediately preceding the claim.
Bloomeor shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, regardless of whether such damages were foreseeable.
Nothing in these Terms limits Bloomeor's liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
Governing Law
Indian law governs these Terms. Disputes are resolved in Bangalore.
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
